How the automatic extension works
Art. 54-bis of the Consumer Code provides that, in the absence of a compliant digital withdrawal function, the ordinary 14-day period automatically extends to 12 months and 14 days. No formal request needed, no authority intervention required: the extension kicks in by operation of law the moment the merchant is no longer compliant.
What this concretely means for your store
Every order received during a non-compliance period is exposed to return requests up to 12 months and 14 days after delivery. If you have 500 orders per month and have not been compliant since 19 June 2026, you accrue financial exposure every day โ in addition to the risk of fines. A customer who bought in July can withdraw until September of the following year.
