Fines for e-commerce without a withdrawal button: what you really risk
The two sanctions provided by the law
Art. 54-bis of the Consumer Code sets two immediate consequences for those not compliant by 19 June 2026. First: administrative fine up to €10,000, framed as unfair commercial practice. Second: automatic extension of the withdrawal period from 14 days to 12 months and 14 days — no customer request required, no prior notice.
What extension to 12 months actually means
Every customer who bought from your store may exercise the withdrawal right up to 12 months and 14 days after delivery. This applies to every order received during the non-compliance period. Financial exposure can be significant, especially for high-volume stores.
Who audits and how checks are run
Checks can be started by the AGCM (Italian Competition Authority) or by consumer associations. A single report or complaint is enough to open an inquiry. The absence of the button is publicly verifiable in seconds.
